Terms of Service

1. Acceptance of Terms

By accessing or using Repetrax (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. Repetrax is a solo indie product operated by an individual, available at repetrax.com and app.repetrax.com, with iOS and Apple Watch apps coming soon.

2. Accounts

You must provide a valid email address and create a password to use the Service. You are responsible for keeping your credentials secure. Do not create multiple accounts to circumvent plan restrictions.

3. Acceptable Use

You agree not to:

• Use the Service to violate any applicable laws
• Upload content you do not have the right to use
• Attempt to reverse-engineer, disrupt, or abuse the Service
• Create multiple accounts to circumvent plan limitations

4. Your Content

You retain ownership of the flashcard decks and content you create. By uploading content, you grant Repetrax a limited license to store and display it solely to provide the Service to you. When you delete your account, your content is permanently removed.

5. Third-Party Imports

When you import content from YouTube or Anki, you are responsible for ensuring you have the right to use that content. Repetrax is not liable for copyright claims arising from imported content.

6. Subscription Plans & Payments

Repetrax offers the following plans, billed via Stripe:

• Free — limited lists and cards
• Premium — unlimited lists, YouTube import, Anki with media
• Pro — iOS offline mode and Apple Watch app (coming soon), everything in Premium
• Founding — one-time lifetime Pro, limited to 50 users

Subscriptions renew annually unless cancelled before the renewal date. Payments are processed by Stripe. We do not store your card details.

7. Founding / Lifetime Plan

The Founding Plan grants access to Repetrax Pro features for as long as the Service is commercially operated. “Lifetime” refers to the lifetime of the Service, not the lifetime of the purchaser. In the event Repetrax permanently ceases operation, no refund will be issued for unused portions of the Founding Plan. Founding Plan holders are not entitled to future features that may be released under higher-tier plans introduced after the date of purchase.

8. Refunds & Right of Withdrawal

Annual subscriptions are non-refundable except where required by law. If you are an EU consumer, you have a 14-day right of withdrawal from the date of purchase, after which no refunds are issued. The Founding Plan is non-refundable after the 14-day withdrawal period. To request a refund within the withdrawal period, contact support@repetrax.com.

9. Account Termination

You may delete your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we discontinue the Service. We will make reasonable efforts to notify you before termination unless doing so would cause harm or is prohibited by law.

10. Data Retention on Deletion

Upon account deletion, your personal data will be deleted within 30 days, except where we are required to retain it for legal or tax compliance purposes (up to 7 years for financial records).

11. Service Availability

We aim to keep Repetrax available at all times but do not guarantee uninterrupted access. We reserve the right to modify or discontinue the Service with reasonable notice.

12. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind. We are not responsible for any loss of data or harm resulting from your use of the Service.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Repetrax's total liability to you for any claim arising from or related to the Service shall not exceed the greater of (a) the amount you paid to Repetrax in the twelve (12) months preceding the claim, or (b) €10. Repetrax is not liable for any indirect, incidental, special, consequential, or punitive damages.

14. Your Data Rights (GDPR)

If you are located in the European Economic Area, you have the right to access, correct, port, or delete your personal data. You may also object to or restrict certain processing. To exercise these rights, contact info@repetrax.com. We will respond within 30 days. You also have the right to lodge a complaint with the Lithuanian Data Protection Authority (vdai.lrv.lt).

15. Changes to These Terms

We will notify you of material changes to these Terms by email or by posting a notice in the app at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Republic of Lithuania. Any disputes will be resolved in the courts of Lithuania.
